Department Description

Under the direction of the General Counsel, the Associate General Counsel - Real Estate and Construction will be responsible for providing legal counsel and assistance in real estate and construction matters. The incumbent of this position will participate in meetings throughout the district related to school construction and alternative financing, providing counsel on matters pertaining to the district's Blueprint for Schools, and providing counsel to staff, formulating policy and litigating matters.

Salary Range: $78,418 - $160,916

Detailed Description

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily.
  • Provides legal assistance in real estate matters including easements, right of ways, purchasing and land swaps; provides direction in land surveying and permit process;
  • Coordinates the collection of documents related to real estate and/or construction related claims and public information requests;
  • Provides guidance on legal compliance obligations under state and federal procurement laws;
  • Represents PGCPS in administrative complaints and litigation related to real estate and construction;
  • Negotiates American Institute of Architects (AIA) agreements; negotiates, revises and finalizes Memorandums of Understanding (MOU) and contracts;
  • Conducts legal research and renders legal opinions on complex issues, including bond offerings, contracts and other transactional matters;
  • Drafts and reviews agreements, leases, contracts and other real estate and construction transactional documents;
  • Prepares and files briefs before the United States Supreme Court, United States District Court of Appeals and Maryland Court of Appeals as needed;
  • Serves as an advisor to the Office of Capital Programs and the Office of Alternative Infrastructure Planning and Development;
  • Works with internal and external teams to secure required construction permits;
  • Performs and promotes all activities in compliance with equal employment and nondiscrimination policies; follows federal laws, state laws, school board policies and professional standards; and
  • Performs other duties as assigned.


  • Job Requirements

    The requirements listed below are representative of the knowledge, skill, and/or ability required.
  • Demonstrated knowledge of alternative financing and bond concepts;
  • Knowledge of Federal, State and City laws, statutes and regulations, including zoning laws;
  • Experience in making presentations, negotiating settlements and writing proposed decisions in complaint cases;
  • Ability to organize, interpret and apply legal principles;
  • Ability to effectively communicate both orally and in writing;
  • Ability to establish and maintain effective working relationships;
  • Ability to manage and work independently in large volume litigation practice;
  • Effective human relations skills; and
  • Demonstrated proficiency with software applications (e.g. Microsoft Office Suite-Word, Excel, Power Point, and Google tools).

  • EDUCATION AND/OR EXPERIENCE REQUIREMENTS:

    Doctorate of Jurisprudence from an accredited law school required. Admission to the Maryland Bar required; admission to the Federal Bar preferred. A minimum of seven (7) years of experience with contract administration and negotiations, risk management and corporate compliance. A minimum of five (5) years of experience handling real estate construction claims, liens and issues related to defect, or reviewing and/or drafting real estate and construction documents. Familiarity with bond issues preferred.

    No direct supervisory responsibilities.
