Risk Management Counsel

Office of Human Resource Services

(Pending availability of funds and Board of Education approval)

The Superintendent invites qualified and interested persons to apply for the position of Risk Management Counsel within the Office of Human Resource Services.

Definition

To provide professional and legal counsel to the Executive Director of Human Resource Services and staff on risk management and affirmative action matters. The examples of work for this title are for illustrative purposes only. A particular individual working in this title may not perform all duties listed in this job specification. Qualifications

  1. Juris Doctorate degree.
  2. New Jersey Bar Admission.
  3. Four (4) to ten (10) years of legal experience in the practice of law, representing school districts before State courts and administrative agencies.
  4. Demonstrated experience in areas of risk management and affirmation action.
  5. Proficiency in applicable computer programs (Westlaw, Word, Windows, Excel).


Responsibilities

Risk Management

1. Renders appropriate day-to-day oral and written legal advice to District administrators on risk management matters.
2. Drafts formal and informal memoranda, opinions, and correspondence for the signature of the Executive Director and other administrators as need for risk management matters.
3. Represents the District at meetings, serves on committees, and engages in projects as directed by the Superintendent and/or the Executive Director of Human Resource Services.
4. Ensures that the District's procedures, which include investigative and reporting responsibilities, are followed.
5. Administers risk management program that promotes the safety of NBOE students and employees while mitigating the District's liabilities.
6. Maintains statistical data on the workplace injuries in order to mitigate future issues and comply with federal reporting requirements.
7. Participates actively in the development/updating of risk insurance operating policies.
8. Monitors, participates in and leads claims investigations, and reports investigation results to the Executive Director of Human Resource Services.
9. Works to promptly to resolve open insurance claims.
10. Keeps abreast of developments and advancements in Workers Compensation and Property Liability policies and enforcement.
11. Prepares clear, technically sound, accurate, and detailed reports containing findings, conclusions and recommendations.
12. Formulates and establishes procedures for reporting of accidents and claims by such means as in-house investigations of accident circumstances, interviews, and hazards identification, and makes recommendations for operational changes to record accurate accident data for claims processing and to detect trends in hazards on government property.
13. Examines liability clauses in various documents such as leases and contracts to recommend adequate levels of indemnification (coverage), reduce risk, and eliminate unnecessary risks.
14. Manage the work of the District's third party plan administrator in the area of workers' compensation claims.
15. Identifies, analyzes and evaluates risks that could cause major financial losses to the District and advises the Executive Director of Human Resource Services.
16. Assists the Executive Director of Human Resource Services in planning, initiating and promoting measures to minimize losses using posters, literature, education and workplace training.
17. Informs General Counsel of all notices of Tort Claims, potential litigation, status of pending litigation and workers' compensation cases.

Affirmative Action

1. Renders appropriate day-to-day oral and written legal advice to the Affirmative Action Officer on affirmative action matters.
2. Drafts formal and informal memoranda, opinions, and correspondence for the signature of the Affirmative Action Officer.
3. Represents the District at meetings, serves on committees, and engages in projects as directed by the Superintendent and/or the Executive Director of Human Resource Services.
4. Ensures that the District's procedures, which include investigative and reporting responsibilities, are followed.
5. Assists the Affirmative Action Officer in providing professional development training for certificated and non-certificated staff.
6. Assists the Affirmative Action Officer in ensuring continuing compliance with state and federal statutes governing educational equity, pursuant to N.J.A.C. 6A: 7-1.1 et. seq.
7. Monitors human resource services and functions to ensure equal opportunities for qualified job applicants and employees.
8. Investigates and resolves complaints of discrimination from employees and applicants.
9. Assists the Affirmative Action Officer administering the District's affirmative action program.
10. Maintains statistical data on the composition of the workforce in compliance with the Civil Rights Act of 1964 and other appropriate legislation.
11. Participates, as directed by the Affirmative Action Officer in the development of Equal Employment Opportunity (EEO) policies.
12. Monitors, participates and leads EEO complaint procedures, and reports the results of all complaint investigations to the Affirmative Action Officer.
13. Keeps abreast of developments in EEO legislation and enforcement generally.
14. Works to promptly resolve employee discrimination complaints.
15. Prepares clear, technically sound, accurate, and detailed reports containing findings, conclusions and recommendations.
16. Informs General Counsel of potential and pending Affirmative Action complaints and all findings related to affirmative action matters.
17. Perform other duties as assigned.

KNOWLEDGE AND ABILITIES

1. Knowledge of the economic and employment conditions, and current placement problems as they relate to maintaining a diverse workforce.
2. Knowledge of the philosophy, principals, and procedures necessary to provide for adequate risk management of public property and casualty exposures including all liability, workers' compensation, and losses due to criminal acts and/or negligence.
3. Knowledge of the insurance industry including standard markets, excess and surplus markets, and reinsurance markets, and of the art of negotiating and procuring insurance from same.
4. Knowledge of state and federal laws dealing with Equal Employment Opportunity and the workings of the agencies which administer and enforce these laws.
5. Ability to establish rapport in the investigation of employee complaints and/or claims and draw objective decisions from the evidence presented.

6. Ability to develop and maintain liaison with departmental officials and other public or private agency personnel.
7. Ability to develop methods and systems to provide relevant Affirmative Action and Risk Management data to the appropriate stakeholders.
8. Ability to prepare evaluative, and project reports of on-going programs.
9. Ability to prepare clear, sound, accurate, and informative progress and other reports containing findings, conclusions, and recommendations.
10. Ability to supervise the establishment and maintenance of the relevant records and files.
11. Ability to utilize various types of electronic information systems used by the agency, office, or related units.
12. Knowledge of methods and procedures used in research and development of information for proper risk management analysis, evaluation, and protection.
13. Knowledge of forms, laws governing leases, contracts, and bids, professional services, and insurance clauses or provisions.
14. Knowledge of methods and procedures used in the review, analysis, and evaluation of insurance policies, coverage, and limits to determine cost effectiveness as to the limits of liability, degree of coverage, and/or self-insured retention needed.
15. Knowledge of methods and formats used in preparing analytical reports, conclusions, and recommendations as to proper risk management.
16. Knowledge of various types of insurance contracts and of the laws, rules, and regulations governing and/or mandating insurance coverage, and the bonding of employees functions or services in the public sector.
17. Knowledge of methods used in loss control inspection and analysis, property appraisal, facility and operation analysis, and the laws pertaining to public employees' Occupational Safety and Hazard Act, and exposure to hazardous substances in the work place.
18. Knowledge of methods and procedures used in compiling risk management records and files to allow for ready access of the information therein contained.
19. Knowledge of proper procedures of investigation and adjustment of claims.
20. Ability to gather information from source material (including other agencies) and physical examination, and to organize such material into usable format for evaluation, analysis, and the recommendation of policy or procedure.
21. Ability to gather, organize, and analyze financial information on which a budget may be prepared.
22. Ability to manage claims, act as liaison between all parties including administrators, attorneys, and claimants, and to see the claim through final adjustment.
23. Ability to advise, guide, and assign work to professional assistants, clerical personnel, and paraprofessional employees.

Salary, Terms & Affiliation

1. Salary: Compensation is competitive and based on experience. The salary range for this position is $120,000-$150,000.
2. Employment Period: Twelve (12) Months
3. Union Affiliation: Unaffiliated
